Thailand Digital Assets Tax-Free for 5 Years
The 399th Ministerial Regulation has been published in the Royal Gazette – and it brings a groundbreaking update: profits from digital assets will be tax-free for five years.
The Ministry of Finance has issued a ministerial regulation exempting capital gains from trading digital assets from personal income tax. This exemption applies from January 1, 2025, to December 31, 2029, creating a significant incentive for investors and entrepreneurs.
The regulation was officially published in the Royal Gazette on September 5, 2025, after being signed on August 27 by then-Deputy Finance Minister Julapun Amornvivat. The legal basis is Article 4 of the Revenue Code, which amends Ministerial Regulation No. 126. The new Article 109 specifies:
“Benefits from the transfer of cryptocurrency or digital tokens that are traded through a digital asset exchange, via a licensed digital asset broker, or with a licensed digital asset dealer under the Digital Asset Business Law, shall only be considered taxable income to the extent that the proceeds exceed the investment cost. This applies to income received between January 1, 2025, and December 31, 2029.”
What does this mean for Thailand?
This move is expected to attract substantial capital inflows and make Thailand even more appealing to expats and international investors. In my view, it’s a strategic and forward-looking decision – especially as Bitcoin continues to gain importance worldwide and is still considered to be in its early stages.
In the long run, Thailand could strengthen its position on the global financial map through this tax exemption.
Naturally, other cryptocurrencies will also benefit from Bitcoin’s momentum. Regardless of the country, encouraging investment and consumption helps to solidify the economy. Often, moderate taxes and favorable regulations generate more sustainable growth than excessive taxation, which frequently leads to capital flight.
